LEASE CANCELLATION
AGREEMENT
This Lease Cancellation Agreement
(herein referred to as “Agreement”) is made and entered into on
[date], by and between [s-Name] (herein referred to as "Landlord")
and [r-Name] (herein referred to as "Tenant"), for the
Property located at [r-Address].
Tenant leases property from Landlord
pursuant to a written lease, which lease is attached hereto and
incorporated by reference. Tenant has requested for permission to
cancel the lease agreement between the parties prior to the
expiration of the lease. Tenant wishes to vacate the premises by
[date], before expiration date of lease.
Landlord agrees to cancel the lease
agreement between the parties provided that Tenant completes the
following provisions:
- Tenant shall provide Landlord with written notice of intent to vacate.
- Tenant shall pay to Landlord the current month's rent of [s-CheckAmount] by [s-DateMonth].
- Tenant shall pay to Landlord an additional amount of [s-AddCheckAmount] by [s-DateAdd] for [s-Reason].
- Tenant shall return all keys to Landlord and completely move and vacate the premises on or before [s-DateLeave], which shall be considered the effective cancellation date.
- Tenant shall provide a forwarding address to Landlord prior to vacating the premises.
- Tenant shall leave the premises in a clean condition and free of any and all damages caused by Tenant.
- Tenant shall permit Landlord to show the premises to a prospective tenant, with prior notice. In the event Tenant is not on the premises, Landlord may enter the premises in good faith and show premises to a prospective tenant.
- Tenant hereby releases any and all claims or causes of action that Tenant may have or that shall arise in the future against Landlord, or against Landlord's employees or agents arising out of the lease agreement.
In the event Tenant fulfills all of the
obligations listed above, Landlord agrees to the following:
- Landlord shall release Tenant from any further obligation to pay rent beyond the amounts listed above.
- Landlord shall not report any poor performance or unfavorable information regarding Tenant to any credit or tenant reporting agencies.
- Landlord shall apply and/or return the security deposit pursuant to the terms of the Lease Agreement attached hereto and incorporated by reference.
In the event Tenant does not fulfill
above terms or is in default under any of the terms of the rental
agreement, management shall have the right to withhold and apply the
aforesaid cancellation fee toward any damages arising as a result of
such default.
